Takedown Policy and Procedures (DMCA)
SengNickerson.com respects the intellectual property rights of others and expects the same in return. Pursuant to the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512(c), copyright owners or their authorized agents may submit a takedown notice to our designated DMCA Agent listed below. As an online service provider, we may claim the DMCA’s “safe harbor” protections when we respond to proper notices.
Notice of Infringement — Claim
To file a good-faith infringement claim, your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material to be removed, with information reasonably sufficient to permit us to locate it (please include the full URL for each item);
- Information reasonably sufficient to permit us to contact you (name, physical address, email address, and telephone number);
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
Note: 17 U.S.C. §512(f) provides for damages (including costs and attorneys’ fees) against any person who knowingly and materially misrepresents that material or activity is infringing.

Counter-Notification — Restoration of Material
If you believe your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our DMCA Agent. Your counter-notification must include:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district in which we may be found if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.
